Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of QA Explorer (the "Service"), operated by [PLACEHOLDER: legal entity name, entity type, registration number, and registered address] ("we", "us", "our").

By creating an account, submitting a scan, or otherwise using the Service, you ("you", "user") agree to be bound by these Terms. You also reaffirm specific portions of these Terms each time you check a consent box in the product — in particular the authorization warranty in Section 4, which you reaffirm for each individual scan target by checking the authorization box on the scan-submission form.

If you do not agree to these Terms, do not use the Service.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

QA Explorer is an AI-assisted automated quality-assurance tool for websites. You provide a URL; the Service crawls a limited set of pages on that site, takes screenshots, captures console errors, runs a set of non-destructive probes, and generates a QA report that may include AI-generated analysis.

The Service is informational. It is not a substitute for professional security testing, penetration testing, accessibility auditing, legal compliance review, or any other professional service. AI-generated findings may be incomplete, inaccurate, or wrong. You are responsible for verifying anything you act on.

3. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract under the laws applicable to you. If you are using the Service on behalf of an organization, you warrant that you have the authority to bind that organization.

4. Authorization & Acceptable Use

This is a core warranty. Read it carefully.

You represent and warrant that, for every URL you submit to the Service as a scan target:

  • You own the website at that URL; or
  • You have explicit, written, and current permission from the owner of that website to perform automated scanning of it.

You acknowledge that scanning websites you do not own or do not have authorization to test may violate applicable laws, including but not limited to computer-misuse and unauthorized-access statutes. The legal risk of submitting a target you are not authorized to scan rests solely with you.

You reaffirm this warranty for each individual scan: by checking the authorization box presented on the scan-submission form before the Service will accept the submission, you are reaffirming this Section 4 warranty for that specific URL.

You agree not to use the Service to:

  • Scan, probe, or test any website you do not own or do not have explicit permission to scan;
  • Attempt to overload, disrupt, or impair any target site;
  • Evade, defeat, or circumvent security controls on any target site;
  • Engage in any activity that is illegal under the laws applicable to you or to the target site's operator;
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service;
  • Scrape, resell, or commercially redistribute the Service or its output beyond your own internal use of the QA reports;
  • Submit content (including in test-account credentials or target URLs) that contains malware, illegal material, or material that violates the rights of any third party.

We may suspend or terminate access for any user we reasonably believe is violating this Section.

5. User Account & Credentials

You are responsible for maintaining the confidentiality of your QA Explorer account credentials and for all activity that occurs under your account. Notify us promptly at the address in Section 16 if you believe your account has been compromised.

When you use the optional "scan the logged-in version" feature, you may provide test-account credentials for the target site (login URL, username/email, password). The handling of those credentials is described in our Privacy Policy. In short: the password is forwarded to the target site once during login, never written to our primary database, scrubbed from job-failure records, and dropped from our queue on scan completion.

6. Responsibilities for Sensitive Data

When you use the "scan the logged-in version" feature, the Service navigates the authenticated site as the test account and captures screenshots of the pages it visits. Anything that account can see — including any customer personal information, payment data, or other sensitive information visible in the authenticated user interface — will appear in those screenshots and become part of the resulting QA report.

You agree that you will:

  • Use only a dedicated test account when enabling the auth-aware scan;
  • Not use any account with access to real customer personal information, real payment data, or other regulated data;
  • Not enter real credit-card details, real bank-account details, or any other real production payment credentials at any time during the scan;
  • Not use a production administrator account.

These obligations are reflected in the warning shown above the credential fields on the scan-submission form. You bear sole responsibility for any sensitive or regulated data you introduce to the Service in violation of this Section.

Users are strongly encouraged to use staging environments and dedicated test accounts rather than production systems.

The Service is not designed for processing regulated personal data, healthcare data, government-classified data, or payment-card production environments.

7. Intellectual Property

The Service, including its software, design, brand, and documentation, is owned by us and our licensors. These Terms do not transfer any of our intellectual-property rights to you.

You retain all rights you hold in the target websites you scan.

The QA reports generated for your scans are yours to use for your own internal QA, security, and accessibility purposes. You may share individual reports as needed. You may not extract reports at scale, redistribute the Service's output as a competing product, or use the Service to build a substantially similar product.

8. Indemnification

You agree to defend, indemnify, and hold harmless QA Explorer, [PLACEHOLDER: legal entity name], and our operators, employees, contractors, and agents from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • (a) your unauthorized scanning of any third-party website;
  • (b) your breach of any representation, warranty, or obligation in these Terms (including the authorization warranty in Section 4 and the sensitive-data obligations in Section 6);
  • (c) your misuse of the Service;
  • (d) any sensitive, regulated, or unlawful data you introduce to the Service;
  • (e) any claim by the operator of a target site arising from scans you submitted.

We reserve the right to assume the exclusive defense and control of any matter for which you are required to indemnify us, in which case you agree to cooperate with our defense.

9. Warranty Disclaimer

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT THE SERVICE WILL MEET YOUR REQUIREMENTS; THAT QA FINDINGS WILL BE COMPLETE, ACCURATE, OR FREE OF FALSE POSITIVES OR FALSE NEGATIVES; OR THAT AI-GENERATED ANALYSIS WILL BE CORRECT. AI-GENERATED CONTENT MAY BE INCORRECT, MISLEADING, OR FABRICATED.

THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL SECURITY TESTING, PENETRATION TESTING, ACCESSIBILITY AUDITING, LEGAL COMPLIANCE REVIEW, OR ANY OTHER PROFESSIONAL SERVICE. YOU ARE RESPONSIBLE FOR INDEPENDENTLY VERIFYING ANY FINDING BEFORE ACTING ON IT.

10. Limitation of Liability

(A) IN NO EVENT WILL OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE GREATER OF (I) THE TOTAL AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (II) ONE HUNDRED UNITED STATES DOLLARS (USD $100). (C) THE LIMITATIONS IN THIS SECTION 10 APPLY REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED (CONTRACT, TORT, STATUTE, OR OTHERWISE) AND REGARDLESS OF WHETHER ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

11. Termination

You may stop using the Service at any time. You may delete your account by contacting us at the address in Section 16 (pending an in-product account-deletion control).

We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe that you have violated these Terms, that your use poses a legal or operational risk to us or to a third party, or as we are required by law.

The following Sections survive termination: 4 (Authorization warranty, as to scans you previously submitted), 7 (Intellectual Property), 8 (Indemnification), 9 (Warranty Disclaimer), 10 (Limitation of Liability), 14 (Governing Law), and 15 (Severability).

12. Privacy

Our handling of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By accepting these Terms, you acknowledge that you have read the Privacy Policy.

13. Modifications

We may revise these Terms from time to time. The current version is always available at https://qaexplorer.com/terms with the "Last updated" date at the top.

If we make material changes, we will display a visible in-app banner the next time you use the Service. Continued use of the Service after the "Last updated" date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

We do not commit to notifying you by email of changes to these Terms; the in-app banner is the notice mechanism.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to conflict-of-law principles.

Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts and enforcement offices of Ankara, Republic of Türkiye.

Nothing in this Section prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or to prevent irreparable harm.

15. Severability & Entire Agreement

If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

These Terms (together with the Privacy Policy) constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings on that subject.

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
